TERMS OF USE & END USER LICENSE AGREEMENT — PetXimo

These Terms of Use ("Terms") are a legal agreement between you and ilustrari LLC ("ilustrari," "we," "us"), a Florida limited liability company, governing your use of the PetXimo mobile application and related services (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By using it, you represent that you are 18 or older and able to enter into a binding contract.

2. License

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial use.

3. Your account

You are responsible for activity under your account and for keeping your sign-in secure. You may delete your account at any time in Settings → Account → Delete account.

4. PetXimo Premium (subscriptions)

  • PetXimo Premium is an optional auto-renewing subscription offered at $3.99 USD per month or $24.99 USD per year (prices may vary by region and may change; current prices are shown in the App). There is no free trial and no lifetime option.
  • Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
  • Your subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • Manage or cancel your subscription anytime in your App Store or Google Play account settings. Deleting the App does not cancel a subscription.
  • Refunds are handled by Apple or Google under their policies; we generally do not provide refunds directly.
  • Essential pet-care features are free. PetXimo Premium unlocks convenience, cosmetic, and AI extras; it is never required to access core pet-care features.

5. Virtual coins and items

The App includes virtual coins and cosmetic items. These have no monetary value, are not real currency, and cannot be redeemed for cash. They are non-transferable and, except as required by law or store policy, non-refundable. We may manage, modify, or discontinue the virtual economy at any time.

6. Advertising

The free version of the App displays advertising. You can remove ads by subscribing to PetXimo Premium. See our Privacy Policy for how advertising data is handled.

7. AI features and NO veterinary advice

The App offers optional AI features, including the "Ximo" assistant and AI document auto-fill. These features provide general information only and do NOT constitute veterinary, medical, or professional advice, diagnosis, or treatment. Always consult a licensed veterinarian for your pet's health. AI output may be inaccurate or incomplete; you are responsible for reviewing and confirming any information before relying on it. In an emergency, contact a veterinarian directly.

8. Your content

You retain ownership of the content you add (such as pet information, photos, and documents). You grant us a limited license to host, store, process, and display that content solely to operate the App for you (including syncing across your devices and, where you choose, processing through AI providers). You are responsible for the content you upload and confirm you have the right to use it.

9. Acceptable use

You agree not to: use the App unlawfully; upload content that infringes others' rights or is illegal; attempt to reverse engineer, hack, or disrupt the App; or use the App to harm others. We may suspend or terminate accounts that violate these Terms.

10. Intellectual property

The App, including its design, software, characters (such as the virtual pet and "Ximo"), artwork, and the PetXimo and ilustrari names and logos, is owned by ilustrari LLC and protected by law. These Terms do not grant you any rights to our intellectual property except the limited license above.

11. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that AI output will be accurate.

12. Limitation of liability

To the fullest extent permitted by law, ilustrari LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.

13. Indemnification

You agree to indemnify and hold ilustrari LLC harmless from claims arising out of your misuse of the App or violation of these Terms.

14. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (such as Sections 10–13) will survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. [Confirm dispute resolution approach with your attorney — e.g., courts located in Florida, or binding arbitration with a class-action waiver. Many U.S. apps include an arbitration clause; have a lawyer draft the exact language.]

16. Apple App Store — additional terms

If you download the App from the Apple App Store, the following apply:

  • These Terms are between you and ilustrari LLC only, not Apple. Apple is not responsible for the App or its content.
  • Your license is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for the App.
  • Apple is not responsible for any product warranties or for addressing any claims relating to the App (including product-liability, legal/regulatory, or intellectual-property claims). To the extent any warranty is not effectively disclaimed, ilustrari LLC (not Apple) is responsible.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited-parties list.

17. Google Play — additional terms

If you download the App from Google Play, your use is also subject to the Google Play Terms of Service, and Google is not a party to these Terms.

18. Changes to these Terms

We may update these Terms. We will post the updated version here with a new date and, where appropriate, notify you in the App. Continued use after changes means you accept the updated Terms.

1. Elegibilidad

2. Licencia

Sujeto a estos Términos, te otorgamos una licencia personal, limitada, no exclusiva, intransferible y revocable para usar la App en dispositivos de tu propiedad o bajo tu control, para uso personal y no comercial.

3. Tu cuenta

Eres responsable de la actividad en tu cuenta y de mantener seguro tu inicio de sesión. Puedes eliminar tu cuenta en cualquier momento en Ajustes → Cuenta → Eliminar cuenta.

4. PetXimo Premium (suscripciones)

  • PetXimo Premium es una suscripción opcional de renovación automática de $3.99 USD al mes o $24.99 USD al año (los precios pueden variar por región y pueden cambiar; los precios vigentes se muestran en la App). No hay prueba gratis ni opción de por vida.
  • El pago se cobra a tu cuenta de la App Store de Apple o de Google Play al confirmar la compra.
  • Tu suscripción se renueva automáticamente por el mismo periodo a menos que la canceles al menos 24 horas antes del final del periodo actual. El cobro de la renovación se realiza dentro de las 24 horas previas al fin del periodo.
  • Gestiona o cancela tu suscripción en cualquier momento en los ajustes de tu cuenta de App Store o Google Play. Eliminar la App no cancela la suscripción.
  • Los reembolsos los gestionan Apple o Google según sus políticas; por lo general no ofrecemos reembolsos directamente.
  • Las funciones esenciales de cuidado son gratuitas. PetXimo Premium desbloquea extras de conveniencia, cosméticos y de IA; nunca es necesario para acceder a las funciones básicas de cuidado.

5. Monedas y artículos virtuales

La App incluye monedas y artículos cosméticos virtuales. No tienen valor monetario, no son dinero real y no pueden canjearse por efectivo. Son intransferibles y, salvo que la ley o la política de la tienda lo exija, no reembolsables. Podemos gestionar, modificar o descontinuar la economía virtual en cualquier momento.

6. Publicidad

La versión gratuita de la App muestra publicidad. Puedes quitar los anuncios suscribiéndote a PetXimo Premium. Consulta nuestra Política de Privacidad sobre cómo se manejan los datos publicitarios.

7. Funciones de IA y SIN consejo veterinario

La App ofrece funciones opcionales de IA, incluido el asistente "Ximo" y el autorelleno de documentos. Estas funciones brindan solo información general y NO constituyen consejo veterinario, médico o profesional, diagnóstico ni tratamiento. Consulta siempre a un veterinario con licencia para la salud de tu mascota. Los resultados de la IA pueden ser inexactos o incompletos; eres responsable de revisarlos y confirmarlos antes de basarte en ellos. En una emergencia, contacta directamente a un veterinario.

8. Tu contenido

Conservas la propiedad del contenido que agregas (como datos de tu mascota, fotos y documentos). Nos otorgas una licencia limitada para alojar, almacenar, procesar y mostrar ese contenido únicamente para operar la App para ti (incluida la sincronización entre tus dispositivos y, cuando lo elijas, el procesamiento mediante proveedores de IA). Eres responsable del contenido que subes y confirmas que tienes derecho a usarlo.

9. Uso aceptable

Aceptas no: usar la App de forma ilícita; subir contenido que infrinja derechos de terceros o sea ilegal; intentar realizar ingeniería inversa, hackear o interrumpir la App; ni usar la App para dañar a otros. Podemos suspender o cancelar las cuentas que infrinjan estos Términos.

10. Propiedad intelectual

La App, incluido su diseño, software, personajes (como la mascota virtual y "Ximo"), arte y los nombres y logotipos de PetXimo e ilustrari, es propiedad de ilustrari LLC y está protegida por la ley. Estos Términos no te otorgan derechos sobre nuestra propiedad intelectual salvo la licencia limitada anterior.

11. Renuncias de garantía

La App se proporciona "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas, incluidas las de comerciabilidad, idoneidad para un fin particular y no infracción. No garantizamos que la App sea ininterrumpida, libre de errores o segura, ni que los resultados de la IA sean exactos.

12. Limitación de responsabilidad

En la máxima medida permitida por la ley, ilustrari LLC no será responsable de daños indirectos, incidentales, especiales, consecuentes o punitivos, ni de pérdida de datos, ganancias o reputación, derivados de tu uso de la App. Nuestra responsabilidad total por cualquier reclamación relacionada con la App no excederá el mayor de el monto que nos pagaste en los 12 meses anteriores o USD $50.

13. Indemnización

Aceptas indemnizar y mantener indemne a ilustrari LLC frente a reclamaciones derivadas de tu uso indebido de la App o del incumplimiento de estos Términos.

14. Terminación

Podemos suspender o cancelar tu acceso si incumples estos Términos. Puedes dejar de usar la App y eliminar tu cuenta en cualquier momento. Las secciones que por su naturaleza deban subsistir (como las Secciones 10–13) seguirán vigentes.

15. Ley aplicable y disputas

Estos Términos se rigen por las leyes del Estado de Florida, EE. UU., sin atender a sus normas de conflicto de leyes. [Confirma con tu abogado el método de resolución de disputas — p. ej., tribunales en Florida, o arbitraje vinculante con renuncia a demandas colectivas. Muchas apps de EE. 16. App Store de Apple — términos adicionales

Si descargas la App desde la App Store de Apple, aplica lo siguiente:

  • Estos Términos son entre tú e ilustrari LLC únicamente, no Apple. Apple no es responsable de la App ni de su contenido.
  • Tu licencia se limita al uso en dispositivos de marca Apple de tu propiedad o control, según lo permitido por los Términos de Servicio de la App Store.
  • Apple no tiene obligación de proporcionar mantenimiento ni soporte para la App.
  • Apple no es responsable de garantías de producto ni de atender reclamaciones relacionadas con la App (incluidas las de responsabilidad por producto, legales/regulatorias o de propiedad intelectual). En la medida en que alguna garantía no se renuncie eficazmente, ilustrari LLC (no Apple) es responsable.
  • Apple y sus filiales son terceros beneficiarios de estos Términos y pueden hacerlos cumplir contra ti.
  • Declaras que no te encuentras en un país sujeto a embargo de EE. UU. ni en una lista de partes prohibidas de EE. UU.

17. Google Play — términos adicionales

Si descargas la App desde Google Play, tu uso también está sujeto a los Términos de Servicio de Google Play, y Google no es parte de estos Términos.

18. Cambios a estos Términos

Podemos actualizar estos Términos. Publicaremos la versión actualizada aquí con una nueva fecha y, cuando corresponda, te lo notificaremos en la App. El uso continuado tras los cambios significa que aceptas los Términos actualizados.
